Real Indie Author ("Company," "we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Site following any changes constitutes acceptance of those changes.

2. DESCRIPTION OF SERVICES

Real Indie Author provides writing coaching services, educational content, and resources for mid-career indie authors, including but not limited to:

  • The Story Stamina System, a proprietary coaching framework

  • One-on-one coaching sessions

  • Digital products and resources

  • Educational content and guidance related to writing craft and creative sustainability

All services are provided subject to these Terms and any separate Service Agreement executed between the parties.

3. ELIGIBILITY

You must be at least 18 years of age to use this Site or purchase services. By using the Site, you represent and warrant that you meet this requirement.

4. USER ACCOUNTS AND REGISTRATION

Certain features of the Site may require you to create an account. You agree to:

  • Provide accurate, current, and complete information during registration

  • Maintain and promptly update your account information

  • Maintain the security and confidentiality of your login credentials

  • Notify us immediately of any unauthorized use of your account

  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. PAYMENT TERMS AND REFUND POLICY

5.1 Payment

All fees for services are due as specified at the time of purchase or as outlined in a separate Service Agreement. Payment is required upfront and must be received before any coaching session, package, digital product delivery, or other services commence (unless otherwise specified in writing in a separate Service Agreement).

5.2 No Refunds

ALL SALES ARE FINAL. All sales for services and products are final and no refunds will be issued under any circumstances, including (without limitation):

  • Change of mind or personal circumstances

  • Dissatisfaction with coaching methods or feedback

  • Failure to complete the program or utilize services

  • Personal financial hardship

  • Creative differences or disagreements

By purchasing services or products, you acknowledge and agree to this no-refund policy.

5.3 Payment Processing

We use third-party payment processors. You agree to comply with their terms and conditions. We are not responsible for errors made by payment processors.

5.4 Late Payment

If payment installments are required per a Service Agreement, failure to make timely payment may result in suspension of services and forfeiture of access to materials until payment is received in full.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Company Content

All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video, data compilations, software, and the Story Stamina System framework (collectively, "Company Content"), is the exclusive property of Real Indie Author or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws, including content related to or describing the Story Stamina System and its related terminology and materials.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Company Content for personal, non-commercial purposes only. This license does not include:

  • Resale or commercial use of the Site or Company Content

  • Collection and use of product listings, descriptions, or prices

  • Derivative use of the Site or Company Content

  • Downloading or copying of account information for the benefit of another merchant

  • Use of data mining, robots, or similar data gathering and extraction tools

  • Reproduction, distribution, modification, or creation of derivative works from Company Content

6.3 Proprietary Methods

The Story Stamina System, including all frameworks, terminology (Lorekeepers, Mythmakers, Heartweavers, Wildscribes), methodologies, and processes are proprietary to Real Indie Author. Users may not reproduce, teach, or commercialize these methods without express written permission.

6.4 User Content

You retain ownership of any creative work you share during coaching sessions ("User Content"). However, by sharing User Content with us, you grant Real Indie Author a limited license to review, analyze, and provide feedback on such content as part of the coaching services. We will not share, publish, or distribute your User Content without your express written permission, except as required by law.

7. USER CONDUCT

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

  • Interfere with or disrupt the Site or servers or networks connected to the Site

  • Attempt to gain unauthorized access to any portion of the Site or any systems or networks

  • Upload or transmit viruses or any other malicious code

  • Collect or harvest information about other users

  • Use the Site to transmit spam, chain letters, or other unsolicited communications

  • Scrape, crawl, data-mine, or use automated means (including bots, spiders, or similar tools) to access, copy, monitor, or extract data or content from the Site without our express written permission

  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site or Company Content without express written permission

  • Engage in conduct that is abusive, threatening, harassing, or defamatory toward Company representatives

Violation of this section may result in immediate termination of your access to the Site and potential legal action.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. 9.1 No Guarantees

REAL INDIE AUTHOR PROVIDES COACHING AND EDUCATIONAL SERVICES FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. REAL INDIE AUTHOR DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE SITE OR SERVICES. Results depend on individual effort and other factors outside our control, including but not limited to market conditions, writing quality, and business acumen. WE DO NOT GUARANTEE BOOK SALES, AGENT OR PUBLISHING OFFERS, BESTSELLER STATUS, OR ANY PARTICULAR PUBLISHING OR BUSINESS OUTCOME. Testimonials and case studies do not guarantee similar outcomes.

9.2 "As Is" Basis

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REAL INDIE AUTHOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SITE OR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  • Your violation of any rights of another party

  • Your User Content

12. TERMINATION

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. We may block access to the Site (in whole or in part) if we believe you have violated these Terms or used the Site unlawfully. Upon termination, your right to use the Site will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alaska, United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Alaska, and judgment on the award may be entered in any court having jurisdiction.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Real Indie Author individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or litigated on a class-action basis.

14. ENTIRE AGREEMENT

These Terms, together with any Service Agreement and our Privacy Policy, constitute the entire agreement between you and Real Indie Author regarding use of the Site and supersede all prior agreements and understandings, whether written or oral.

15. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

16. WAIVER

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
